Terms of Service

To use Crackto, you must meet the following requirements:

• You must be at least 13 years old. Users under 18 must have parental or guardian consent.
• You must provide accurate and complete information during registration.
• You must have the legal capacity to enter into binding contracts.
• You must not be barred from using our services under applicable laws.
• You must be a resident of India or have legal permission to access our services.

2.1 Account Registration

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

2.2 Account Types

• Free Account: Limited access to basic features and mock tests
• Premium Account: Full access to all tests, analytics, and premium content
• Institutional Account: Custom plans for educational institutions

2.3 Account Security

• You are responsible for maintaining the confidentiality of your login credentials
• We recommend using strong passwords and enabling two-factor authentication
• Sharing your account with others is prohibited and may result in suspension
• We are not liable for any loss or damage arising from unauthorized account access

3.1 Permitted Uses

You may use Crackto to:

• Access and use mock tests and study materials for personal exam preparation
• Track your performance and view analytics
• Participate in community discussions and forums
• Download content for offline use (where permitted)

3.2 Prohibited Activities

You may NOT:

• Share, distribute, or resell our content without written permission
• Use automated tools (bots, scrapers) to access the Platform
• Reverse engineer, decompile, or modify any part of the Platform
• Upload malicious code, viruses, or harmful content
• Impersonate others or create fake accounts
• Harass, abuse, or threaten other users
• Cheat, manipulate test results, or use unfair means
• Violate any applicable laws or regulations

3.3 Content Ownership

• All content on Crackto (tests, questions, videos, graphics) is owned by Crackto.
• You receive a limited, non-exclusive, non-transferable license to use our content
• You may not copy, modify, distribute, or create derivative works from our content
• Any user-generated content (comments, posts) remains your property but you grant us a license to use it

4.1 Pricing & Plans

• Subscription prices are listed on our Pricing page and may change with notice
• All prices are in Indian Rupees (INR) unless otherwise stated
• Taxes (GST) will be added to your subscription as applicable
• Promotional discounts may apply based on offers and coupon codes

4.2 Billing & Payment

• Payment is due immediately upon subscription purchase
• We accept credit/debit cards, UPI, net banking, and digital wallets
• Subscriptions auto-renew unless cancelled before the renewal date
• You authorize us to charge your payment method for recurring subscriptions
• Failed payments may result in service suspension

4.3 Refunds & Cancellations

• Refund eligibility depends on your subscription type and usage
• Refund requests must be submitted within 7 days of purchase
• No refunds for subscriptions used beyond 30% of the validity period
• Cancellations take effect at the end of the current billing cycle
• Refunds are processed within 7-10 business days

5.1 Our Intellectual Property

• Crackto and all content (tests, questions, videos, graphics, software) are protected by copyright, trademark, and other IP laws
• The Crackto name, logo, and branding are trademarks of Crackto.
• You may not use our trademarks without prior written permission
• All rights not expressly granted to you are reserved by us

5.2 User-Generated Content

When you post content (comments, reviews, feedback), you:

• Retain ownership of your content
• Grant us a worldwide, royalty-free license to use, modify, and display your content
• Warrant that you have the rights to the content you post
• Agree not to post copyrighted material without permission

5.3 Copyright Infringement

If you believe content on Crackto infringes your copyright:

• Send a notice to legal@crackto.com with details of the infringement
• Include your contact information and a description of the copyrighted work
• Provide the URL or location of the infringing content
• Include a statement of good faith belief that use is unauthorized

6.1 "As Is" Service

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING:

• Merchantability and fitness for a particular purpose
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free service
• Security or freedom from viruses
• Results or outcomes from using our services

6.2 No Guarantee of Success

• We do not guarantee that using Crackto will result in exam success
• Test scores and performance on our platform do not reflect actual exam results
• We are not responsible for any examination outcomes
• Study materials are for preparation purposes only

6.3 Third-Party Content

• We may link to or integrate third-party services and content
• We are not responsible for third-party websites, services, or content
• Your use of third-party services is at your own risk
• Third-party terms and privacy policies apply

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRACKTO SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions, errors, or data loss
• Unauthorized access to or alteration of your data
• Third-party conduct or content on the Platform

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR ₹1,000, WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless Crackto, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your use or misuse of the Platform
• Your user-generated content
• Your breach of any representations or warranties

9.1 By You

• You may terminate your account at any time through account settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial subscription periods (subject to Refund Policy)
• You remain responsible for all charges incurred before termination

9.2 By Us

We may suspend or terminate your account immediately without notice if:

• You violate these Terms or our policies
• You engage in fraudulent or illegal activity
• Your account remains inactive for 2+ years
• We are required to do so by law
• Continuing service would harm us or other users

9.3 Effect of Termination

• Your right to access the Platform immediately ceases
• We may delete your account data (subject to legal retention requirements)
• Provisions that should survive termination remain in effect
• No refunds are provided for violations leading to termination

10.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@crackto.com to attempt informal resolution of the dispute.

10.2 Binding Arbitration

If informal resolution fails, disputes will be resolved by binding arbitration:

• Arbitration will be conducted under the Arbitration and Conciliation Act, 1996
• Arbitration will take place in New Delhi, India
• The arbitrator's decision is final and binding
• You waive your right to a jury trial or class action

10.3 Exceptions

The following disputes are not subject to arbitration:

• Claims for injunctive or equitable relief
• Intellectual property disputes
• Small claims court matters (within jurisdictional limits)

10.4 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES INDIVIDUALLY AND WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS-WIDE ARBITRATION.

11.1 Governing Law

These Terms are governed by the laws of India. Courts in New Delhi have exclusive jurisdiction.

11.2 Modifications

We may update these Terms at any time:

• Material changes will be notified via email or in-app notification
• Continued use after changes constitutes acceptance
• The "Last Updated" date reflects the latest revision

11.3 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

11.4 Entire Agreement

These Terms, along with our Privacy Policy and other policies, constitute the entire agreement between you and Crackto.

11.5 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

11.6 Assignment

You may not transfer your rights under these Terms. We may assign our rights to any successor or affiliate.
